Terms of Service

The rules of the road for using Hey Vitae.

Hey Vitae is operated by Functioning Labs LLC. These terms cover what you can do with the product, what we promise (and don't), and what happens around billing, content, and AI features.

TL;DR

The friendly version.

  • Use Hey Vitae for your own job search. Don't scrape, abuse, spam, or resell it.
  • You own your job-search content; we get a narrow license to host, process, and display it — including on Spotlight pages you publish.
  • AI features are assistive, not authoritative. Review what they produce before you send, publish, or rely on it.
  • Hey Vitae can help you organize and improve your job search, but we don't guarantee interviews, offers, employment, or employer responses.
  • Subscriptions auto-renew until you cancel. The 3-month Pro pass is a one-time purchase that expires and doesn't renew.
  • Purchases are generally final and non-refundable except where required by law or stated at checkout.
  • Refer a friend: they get $10 off their first paid plan; you earn $10 in non-cashable account credit once their payment clears. Codes are personal — abuse can void credits.
  • Be respectful in anything you publish or send through the product.

Section 1

Who we are.

Hey Vitae is a job-search workspace operated by Functioning Labs LLC, a Massachusetts limited liability company, as part of the Functioning Human product family. References to “we,” “us,” or “Hey Vitae” mean Functioning Labs LLC acting through the Hey Vitae product. By creating an account or using any part of the service, you agree to these terms.

Section 2

Eligibility and accounts.

You must be at least 13 years old to use Hey Vitae, and at least the age of majority in your jurisdiction to enter a paid plan. If you're under 18, you may use Hey Vitae only with permission from a parent or guardian.

You're responsible for keeping your login credentials safe and for everything that happens under your account. Tell us right away at hello@heyvitae.com if you think your account has been accessed by someone else.

Section 3

What you can do with Hey Vitae.

We grant you a personal, non-exclusive, non-transferable, revocable license to use Hey Vitae to run your own job search. That includes tracking jobs, drafting documents, preparing for interviews, publishing Spotlight portfolio pages, and using the browser extension for sites we support.

You agree not to:

  • Scrape, reverse-engineer, decompile, or attempt to access the source code of the service.
  • Interfere with, disrupt, or overload the service, its users, or its providers.
  • Use bots, scrapers, crawlers, or other automated methods to access the service except as we expressly allow.
  • Upload malware, illegal content, or content you don't have rights to use.
  • Use AI features to harass, deceive, mislead, or impersonate other people.
  • Use the email features for spam, phishing, recruiting spam, mass unsolicited outreach, or other abusive messaging.
  • Share your account or resell access without our written permission.

Section 4

Your content.

You keep ownership of everything you put into Hey Vitae — resumes, cover letters, application notes, interview prep, Spotlight pages, and anything else.

To run the service, you give us a worldwide, royalty-free license to host, store, transmit, display, and process that content for the purposes you're using the product for — including showing your Spotlight pages publicly when you choose to publish them, and routing prompts you create through AI providers when you use AI features. This license ends when your content is deleted from the service, except where copies remain in backups, logs, or legal records, or where the content was already shared publicly or with others.

You're responsible for the content you put in. Don't upload material you don't have the rights to use, and make sure your content doesn't violate confidentiality obligations, NDAs, employer policies, or third-party rights. In particular, don't put confidential information of a current or former employer onto a public Spotlight page.

Section 5

AI features.

Hey Vitae uses AI to analyze job postings, suggest improvements to documents, draft outreach, and surface insights. Requests are routed through Vercel AI Gateway to providers including OpenAI and Anthropic. AI providers, models, and routing may change over time.

AI output is informational and assistive. It can be wrong, incomplete, biased, or out of date. You are responsible for reviewing anything an AI feature produces before you send, publish, or rely on it. AI output is not professional legal, financial, medical, immigration, tax, or employment advice, and it does not replace your own judgment or advice from a qualified professional.

We don't use your private content to train public AI models. See the Privacy Policy for the data details.

Hey Vitae can help you organize and improve your job search, but we don't guarantee interviews, offers, employment, compensation, or employer responses.

Section 6

Spotlight pages and shared links.

Spotlight pages are public the moment you publish them, and the URLs are designed to be shared and tracked. Treat job-specific share URLs as public links, not private secure portals — anyone they're sent to can re-share them. Don't put anything on a Spotlight page that you wouldn't want a recruiter, a hiring manager, or the open web to see.

We don't review every Spotlight page before publication. We may remove or disable a Spotlight page that violates these terms or that we believe in good faith infringes someone else's rights.

If you unpublish or delete a Spotlight page, we'll stop displaying it through Hey Vitae, but we can't control copies, screenshots, search-engine caches, or links already shared outside the service.

Section 7

Email features and the browser extension.

Some features connect Hey Vitae to email messages, mailbox addresses, or job-board pages through the browser extension. You represent that you have the right to forward, parse, store, and process the messages and page content you bring into Hey Vitae.

You agree not to use the email features for spam, phishing, harassment, deception, unlawful outreach, or high-volume unsolicited messaging. You also agree not to use the extension in a way that violates applicable law or the terms of any third-party site you interact with through it.

Browser extensions may also be subject to the terms and policies of the browser or extension marketplace where you install them.

Section 8

Plans, billing, refunds, and promotions.

Free accounts come with usage limits. Paid plans (Pro and Pro+) renew automatically each billing cycle until you cancel. The Pro 3-month pass is a one-time purchase that gives you Pro access for the period stated at checkout and then expires; it does not auto-renew.

Cancel anytime through the Stripe billing portal; your plan stays active until the end of the current period and then drops back to Free. Taxes may be added where required. If a payment fails, we may downgrade, suspend, or terminate paid access after reasonable retry or notice.

Unless required by law or expressly stated at checkout, purchases are final and non-refundable. This does not limit any rights you may have under applicable consumer protection laws.

We may offer trials, discounts, coupons, or promotional plans. The terms shown at checkout or in the offer control. Unless stated otherwise, promotions are available for a limited time, may be changed or withdrawn, and may not be combined with other offers.

Our referral program rewards both sides of a real word-of-mouth introduction. A referred friend gets $10 off their first paid plan, and the referrer earns $10 in non-cashable account credit once that first paid invoice clears. The referee discount applies once per customer, on the first paid plan only. Referrer credit is applied automatically to your next Hey Vitae invoice, has no separate cash value, and is not redeemable for cash, transfer, or chargeback. Codes and referral links are personal: we may review, withhold, or reverse credits we reasonably believe were earned through self-referral, manufactured signups, chargebacks, refunds, or other gaming of the program. We may modify or end the referral program at any time; changes apply prospectively.

Some Hey Vitae paid plans or promotional offers may include bonus access to Functioning Human or other Functioning Labs products. Bonus access is included only when stated at checkout or in the offer terms. It may be limited by plan, duration, feature set, account status, or availability.

If your Hey Vitae paid plan is canceled, expires, refunded, charged back, downgraded, or terminated, any included bonus access may also end. Bonus access has no separate cash value, cannot be exchanged for a refund or credit, and may change over time.

We may change pricing or features prospectively. If a material change affects your paid plan, we'll provide notice where required by law or where reasonably practical.

Section 9

Service availability and beta features.

We may add, change, suspend, or discontinue features at any time. We'll try to give reasonable notice when a material change affects paid functionality, but we don't guarantee that every feature will remain available forever.

Some features may be labeled beta, experimental, or preview. These features may be less reliable, may change without notice, and may be removed or limited at any time.

Section 10

Third-party services.

Hey Vitae relies on third-party providers to operate the service. Your use of some features may also be subject to those providers' terms — for example, Stripe's payment terms when you subscribe, or browser-extension store terms when you install the extension. The providers we currently rely on:

  • Functioning Labs LLC / Functioning Human — our related product family, shared identity and billing infrastructure, and optional bundled access for eligible Hey Vitae plans.
  • Supabase (database, authentication, file storage).
  • Vercel (application hosting and the AI Gateway that routes model requests).
  • Stripe (payments and subscription management).
  • OpenAI and Anthropic (AI model providers behind analysis and drafting features).
  • Google (Tag Manager and Analytics, only with your consent).
  • Sentry (error monitoring).
  • Postmark (transactional and mailbox email delivery).
  • Brevo (marketing email, only when you opt in).

Section 11

Intellectual property, feedback, and copyright.

Hey Vitae, the “Hey Vitae” name, the Functioning Human family of products, and the look, feel, and code of the service are owned by Functioning Labs LLC and protected by intellectual-property laws. Nothing in these terms transfers any of those rights to you. You may not use our names, logos, branding, or product screenshots in a way that suggests endorsement without our permission.

If you send us feedback, ideas, or suggestions, you grant us permission to use them without restriction or compensation to you.

We respect copyright. If you believe content on a Spotlight page or elsewhere on the service infringes your copyright, send a notice with the information described in 17 U.S.C. § 512(c)(3) to hello@heyvitae.com. We'll respond consistent with the DMCA — including by removing or disabling access to material we determine in good faith to be infringing and by terminating repeat infringers' accounts where appropriate.

Section 12

Termination.

You can close your account at any time from Settings. We may suspend or terminate an account for serious or repeated violations of these terms, for non-payment, or if we reasonably believe continued service creates legal, security, or safety risk.

On termination, your access ends and your content may be deleted after a short wind-down period. We may preserve information where required for legal, security, fraud-prevention, or billing purposes. See the Privacy Policy for retention details.

Section 13

Disclaimers, liability, and indemnity.

Hey Vitae is provided “as is” and “as available.” We don't guarantee that the service will be uninterrupted, error-free, or that any particular feature, recommendation, or AI output will produce a specific outcome (such as an interview or a job offer).

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or lost opportunities. Our total liability for any claim related to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) fifty US dollars.

You're responsible for claims that arise from your content, your violation of these terms, or your misuse of the service, to the extent permitted by law.

Some jurisdictions don't allow certain disclaimers or limitations of liability, so parts of this section may not apply to you.

Section 14

Governing law.

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Massachusetts, and you agree to that venue.

Section 15

Changes to these terms.

We may update these terms from time to time. When we do, we'll change the effective date at the top, and material changes will be flagged in-product or by email. Continued use after the effective date means you accept the updated terms.
